We are excited to now bring you an online catalog monthly of horses, ponies, mules, and donkeys consigned to the sale! Consigned animals will sell in numerical order and those consigned ahead will SELL FIRST.   Here on this online bidding platform, you can watch and bid live just as you are here with us in person. However, you will now have listings available to you ahead of time, you’ll know their hip number and the order they will sell in. This will make it easier for our online bidders to participate and hopefully get the horse(s) they have their eyes on! As soon as a horse, pony, mule, or donkey is posted, early absentee bidding becomes available to you! This works much like ebay for those of you familiar with that. You can place your maximum bid ahead of time and the computer will then act as your agent at sale time, bidding on your behalf by minimum increments to keep you in the lead. This option is useful for those of you with poor internet/cell service at home, those who are unable to watch live for any reason, and also for you folks who find the fast pace of a live auction to be intimidating. PLEASE NOTE that if you place an early absentee bid and that animal comes into the ring with an announcement that changes the information that was available to you when you placed your bid (i.e. the horse cribs but that was not disclosed in the listing) we will NOT honor your pre-bid for your protection. We want you to bid with the most accurate information available!   For those of you who prefer to watch and bid live, you’ll have real time audio/video available to you at sale time! Make sure you have registered to bid, are logged in, and then hit the “Play” button on the live feed!  You’ll be good to go and can participate just as if you were here in person!   For those of you using a mobile device, we do recommend downloading the Horse Auctions USA app for the best bidding experience! It is available FREE to download from the Google Play and App Stores!  If you prefer to use your browser, we do recommend using Google Chrome   You will need to register with a credit/debit card in order to bid online. Please note that a pre-authorization for $500 will be placed on your registered card. This is NOT a charge, just an authorization to verify you are indeed a real person with a real card and is a good faith hold to allow you to bid. This authorization will fall off once the sale is complete and any purchases you have made are paid for. This is for your protection as a buyer. We want you to bid with the most accurate information possible.  Live Bidding on Sale Day: For those who prefer to participate in real time, we will have a live webcast..... Make sure you have registered to bid and that you are logged in. On sale day, there will be a "View Live" button available - push that and join us live! You will have real time feed with bid buttons available so you can participate as if you were with us in person.  PLEASE NOTE! We do this sale at the campground. It is a BEAUTIFUL setting for our event but we do struggle with internet connectivity. We do our best to bring you the clearest video feed possible but please understand that we are limited by location. This is something we have tried to address several ways and continue to work on! We have to make do the best we can with this beautiful setting and all the signal blocking trees that come with it!  :)      We've got BRAND SPANKING NEW SATELLITE INTERNET for the September Sale! We've tested things out and it looks like we may just FINALLY have truly reliable service. We'll leave all of the "just in case" information up on here but it looks like we'll be more than good to go to be live! There is still the very real possibility that no matter what solutions we put in place, we just may not have enough bandwidth to push live video feed (although with the new service, that possibility is much smaller than in years past)! While we certainly hope that isn't the case, we do want to prepare for that possibility. IF that happens, we will be able to run the live bidding itself so you can still bid in real time - you just won't have the live video feed.  Not ideal but most of the horses have enough photo/video material posted ahead to give folks a good look ahead of time. Hopefully, it doesn't come to that but we would rather prepare everyone for the possibility "just in case"   I won, now what?!?! A member of the KS Select Office team will be in touch with winning bidders as soon as possible. It may be once the sale is over (this depends entirely on just how busy that sale office gets). But someone will be reaching out! You'll make payment for your winning bids directly to the KS Select office. If you need to reach someone before this you can try the following but PLEASE remember that just because you are done bidding doesn't mean the auction is over. TITLE: By submitting a consignment form, Consignor agrees to the terms and conditions set forth below and swears that the information furnished regarding this entry is true and correct. Consignor further agrees that he/she has absolute and complete title/ownership to the entry listed in this document. In the event that Freedom Select is required to resort to legal action to enforce the terms of this contract, consignor agrees to pay attorney fees and costs associated with or arising from such action. This Consignment Agreement is to be construed as to form, substance, and procedure in accordance with the laws of the State of Pennsyvania, and the Consignor and Consignee hereby agree to submit to the jurisdiction and venue of a court of competent jurisdiction in Venango County, Pennsylvania. 2. LIABILITY: As owner of the horse(s) consigned in any sale Consignor understands that he/she maintains ownership until the sale is final and at which time ownership transfers to the buyer. Consignor understands that Freedom Select is acting as the consignor’s agent only and thus bears no responsibility or liability for ownership of the horse(s) at anytime during the consignment process. Consignor does hereby release and hold Freedom Select harmless from any and all responsibility and/or liability from any claims or legal action of any type arising from anything associated with this consignment sale and does further agree that should any such arise, the consignor will cooperate fully with Freedom Select to fully absolve them from any responsibility or liability which includes taking any necessary steps necessary to legally defend them against claims or lawsuits. Freedom Select acts as agents only and is not responsible for buyer/seller error or misunderstanding. 3. WITHDRAWAL OR REJECTION: Freedom Select reserves the right to reject any entry for any reason. Entry fees will only be refunded if rejected prior to the cataloging on May1st, 2024. Once cataloged, rejection, or withdrawal may come only as a result of unsoundness or “unfit for sale” conditions, and the entry may be made substituted on approval of Freedom Select. Consigner agrees that once this application is accepted by Freedom Select, the consigner is obligated to present the consigned animal at the time of sale or pay the “never offered” fee listed in section 7-a-iv of this document. If consigner sells the consigned animal privately prior to or on the date of the sale, consigner agrees to pay Freedom Select the commission fee listed in section 7-a-ii based on the private sale price + the “never offered” fee listed in section 7-a-iv. 4. SOUNDNESS GUARANTEE: e. All Guarantees are strictly between the buyer and seller. iii. $200.00 No Sale fee if bidding ends under reserve iv. $500.00 Never Offered Fee b. I do hereby agree that Freedom Select is authorized to deduct the selling fees and commission from the proceeds when making payment to me. I further agree that in the case of “No Sale", I will present payment to Freedom Select prior to removing the consigned animal from the property where the sale is being held. c. I agree that if I sell the entry at the venue that the sale is being held, either before or after the animal has been through the sale ring, the transaction will go through Freedom Select and commission will be paid. 5. LIABILITY FOR ILLNESS: I understand and agree that Freedom Select does not assume and will not accept any liability for injury, illness, or accident to any animal listed and/or consigned for sale. 6. TRANSMITTAL OF DOCUMENTS: The completed consignment form and entry fees must be received by Freedom Select no later than May 1st, 2024 to secure a spot in the sale. All registration certificates, transfer reports, breeder’s certificates, foal applications must be submitted to Freedom Select prior to the start of the sale and all forms must be signed by the owner or legal agent thereof. Freedom Select will withhold payment to the consignor until the consignor furnishes to Freedom Select all necessary documents for the transfer of the horse to the new owner. 7. REGISTRATION FEES & COMMISSION: a. I agree to pay according to the fee schedule listed below i. Consignment Fee = $50 per horse ii. 10% commission fee for each horse sold ($200 minimum, $1000 maximum) 8. PAYMENT OF PROCEEDS: I hereby agree Freedom Select will tender payment to me in full for this consignment, having made the necessary deductions listed in these Terms and Conditions of Consignment, however Freedom Select is not required to make payment to me until the buyer has made satisfactory payment to Freedom Select and until all payments from the buyer have had funds clear the bank. In addition Any questions or concerns about online bidding should be directed to Amber Lee Kain 336-564-7650 9: ONLINE BIDDING: ALL WINNING INTERNET BIDS will incur a 4% online Buyers Premium  All internet bidders must place a valid credit/debit card on file with Horse Auctions USA in order to be approved for online bidding. At that time, Horse Auctions USA will place a $500 pre-authorization on that card. This is NOT a charge (though some mobile banking apps will send a notification at the time of authorization that looks like a charge - again it is NOT a charge). This authorization will fall off and "disappear" at the conclusion of the auction for all registered bidders who WERE NOT successful winning bidders. For those online bidders who are successful, this pre-authorization will be released once final payment for purchases is confirmed received by Legacy Freedom Select. Bidding online is the same as bidding in person and is a legally binding agreement. In the event that a winning online bidder fails to complete the transaction by making final payment to Freedom Select Horse Sale as outlined in Clause 1 above, Horse Auctions USA WILL NOT release this pre-authorization but rather, will complete it and the online bidder agrees to forfeit the $500. Further, online bidders understand and acknowledge that failure to complete a transaction does NOT absolve them from the financial obligation of being the winning bidder and is aware that Horse Auctions USA reserves the right to charge the total amount owed to Legacy Freedom Select Horse Sale for winning bids to the registered card to resolve the debt owed by the bidder to Freedom Select. Should this unfortunate step become necessary, you will have all future bidding privileges online with Horse Auctions USA revoked permanently.
